I have heard around that the Topic of a Survey about black cabs has been raised in the open Cabinet meeting of the new Lib Dem cabinet. I was told that the Survey according to the minutes of Jan 08 meeting was to be done again by February 09. It was raised I believe at Cabinet that this be changed, and some pointed out that the Lib Dem motion at the original meeting of the full council in January 08 was not to have a survey until Feb 2010. Does anybody know if they are to put off the Survey according to thier motion. Is this legal. And also if they go back to Council with their original motion to change it would they have to also allow further licences as the motion stated that the limit should be 865 and we dont have that many licence yet do we?

Thoughts on this anyone.

They can put it off but how long can that survey be defended for? If it goes past it's sell by date then they leave themselves open to challenges that they can't refuse a plate cus they have no survet to suggest no unmet demand, isn't that so then vulcan?

I beleive from stated cases that a survey has a life of 3 years, probably why the lib dems say 2010. Also you dont need a survey to lift limitation but you need one to maintain a limit. The current position is that no body has challenged this survey as they are already over the limit they set, how do you defend that in Court.

I appologise for what seems a late reply but I haven't had a chance to read all threads yet. This is an interesting situation now that the survey looks to be delayed. With my limited knowledge of the Law. I'd say a challenge is quite likely to succeed after the survey sell by date. For the council to simply refuse without justification (justification provided by the survey), is against the OFT guidelines. What are your thoughts?

My sentiments too, a bit like when they set the limit to 835 then fearing a challenge decided to issue more.
