TWO Sheffield brothers have been found guilty this afternoon of murdering city taxi driver Younis Khan.
David Cohen, aged 28, of Philadelphia Gardens, Upperthorpe, and his brother Ashley Cohen, 25, of Clough Wood View, Oughtibridge, were convicted by jurors at Sheffield Crown Court following a five-week trial.
The brothers held their heads in their hands as High Court judge, the Honorable Mr Justice Langstaff, told them: "There is only one sentence that can be given for murder and that is one of life imprisonment. Life means life."
It was never said in court who pulled the trigger on the gun that killed Mr Khan last March.
But the brothers were found guilty of arranging for the 53-year-old father-of-five, of Abbeyfield Road, Pitsmoor, to be shot dead as he drove his black cab along nearby Scott Road.
Jurors took over 13 hours to decide the Cohen brothers had masterminded the brutal murder of Mr Khan at the wheel of his cab.
They had initially wanted to kill Mr Khan's son Imran, after discovering he took a gun to David's house in revenge for trouble at a city centre nightclub.
But when they could not track Imran down, they arranged for his father to be shot dead instead.
The prosecution said the gunman who killed Mr Khan stood in front of his cab, aimed a
first shot through the windscreen, and then opened fire another five times as he drove
past.
A firearms expert said the second bullet fired from a 9mm Russian gun was the one that killed him. Mr Khan crashed his cab and bled to death.
Ashley Cohen and another man, David Ashmore, 45, of Dykewood Drive, Wadsley, had already been found guilty of conspiracy to pervert the course of justice.
Jurors decided they were responsible for disposing of a car used by the gunman following the killing.
Less than an hour earlier their co-accused, Ramzan Mirza, aged 27, of Staniforth Road, Darnall, walked free from court an innocent man after being cleared of murder.
Mr Mirza had been linked to the scene by DNA on a cigarette end - something he said was explained by the fact he used to buy drugs on the street.

A SHEFFIELD man who triggered a chain of violent events which led to his father's murder has escaped prosecution - despite admitting carrying a firearm.
Imran Khan, aged 26, testified during the trial of his father’s convicted killers that he had taken what he claimed was an imitation gun to one of their houses hours before.

Mr Khan, formerly of Abbeyfield Road, Pitsmoor, but who has now moved away, also made the same confession to police before the trial.

When forensics experts examined the house - the home of David Cohen, of Philadelphia Gardens, Upperthorpe - they found a bullet lodged in one of the window frames.

That gave police a motive for Imran Khan’s 53-year-old father Younis Khan’s murder.

Detectives believed Imran Khan’s imitation gun was in fact real, and had been fired - sending David Cohen in search of revenge for the attack, enlisting his younger brother Ashley, of Clough Wood View, Oughtibridge, to organise murder.

Taxi driver Younis Khan was shot dead as he drove his cab near his Pitsmoor home in March 2007.

Imran Khan was later charged with possessing a firearm with intent to cause fear of violence - but he went to Leeds Crown Court to ask for the case against him to be dropped.

His legal team said he had been led by police to believe he would not be prosecuted if he gave evidence against the Cohen brothers, and that it would be “unfair” if the case against him went ahead.

Mr Recorder Hawks agreed, and said although Mr Khan had been facing “a serious matter” he believed the defendant had admitted his own criminality only in the genuine belief he would not face prosecution.

He also pointed out that when Mr Khan had made the confession to police he had not been cautioned, and when he made the same allegations during the subsequent murder trial the judge did not warn him about the dangers of “self incrimination” when giving evidence.

He stressed South Yorkshire Police and the Crown Prosecution Service had not done anything wrong in their dealings with Mr Khan, pointing out they had needed his co-operation to help them crack the case.

“I refute any suggestion that at any time they made deliberate promises or inducement,” he said. “The arrest and successful prosecution of those responsible for the death of Younis Khan was the number one priority for the police.

“When his body was discovered it appeared to be a completely motiveless crime. Imran Khan was a vital link in the chain so far as the prosecution of the Cohens was concerned.

“The defendant was only of any value if he admitted some significant criminality of his own. In order to obtain a statement and co-operation the police had to act in an extremely delicate fashion.

its time life means life /to easy the prison system /bring back the stocks in the town center .to start with /shop lifters/theft / abusive / they can go first .leave them there a couple of days and then take the court action .and get rid of this human rights crap and .
