LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976
STANDARD CONDITIONS FOR PRIVATE HIRE DRIVERS LICENCE
A. The Licence must comply with the Standard Conditions attached to Private Hire Drivers Licence.
B. The Licensee shall at all times when acting in accordance with this licence, wear in such a position as to be plainly and distinctly visible, the badge issued to him/her by the Council, pursuant to section 54(1) Local Government (Miscellaneous Provisions) Act 1976.
C. The Licensee shall at all times, when acting in accordance with this licence, be
clean and respectable in his/her dress and person. He/she should conduct themselves in an orderly manner and will civility and propriety towards every person hiring or being conveyed in a private hire vehicle driven by him/her. The licensee shall comply with every reasonable requirement of the hirer or person being conveyed in the vehicle.
D. The Licensee shall take all reasonable precautions to ensure the safety of persons conveyed in or entering or alighting from any private hire vehicle driven by him/her.
E. The Licensee shall ensure that all passengers, adults and children, are restrained by seatbelts in accordance with the current seat belt legislation.
F. The Licensee shall not convey or permit to be conveyed in a private hire vehicle driven by him/her any greater number of persons (excluding the Licensee) than the number of persons specified on the plates provided by the Council and affixed to the vehicle.
G. The Licensee when required by the hirer of any private hire vehicle by him/her shall not refuse to carry in the vehicle the number of persons specified on the plates provided by the Council and affixed to the vehicle, or any less number as required by the hirer.
H. If the Licensee has agreed or has been hired to be in attendance with a private hire vehicle at any appointed time and place he/she shall, unless delayed or prevented by some sufficient cause, punctually attend with the vehicle at such appointed time and place.
J. If the Licensee has agreed or has been hired to be in attendance with a private hire vehicle so constructed as to carry luggage he/she shall, when requested by the hirer or any person being conveyed in the vehicle:-
(i) conveyed a reasonable quantity of luggage;
(ii) afford reasonable assistance in loading and unload;
(iii) afford reasonable assistance in removing it to or from the entrance of any house, station or place at which he/she may take up set down such person or persons.
K. If the Licensee knowingly conveys, in any private hire vehicle, driven by him/her, the dead body of any person, he shall immediately thereafter notify the fact to the Council’s Director of Housing and Environment
L. The Licensee shall immediately after the termination of any hiring of a private hire vehicle driven by him/her or as soon as practicable thereafter carefully search the vehicle for any property which may have been accidentally left therein.
M. The Licensee shall, if, any property accidentally left in any private vehicle, by any persons who may have been conveyed, in the vehicle, by the Licensee, be found or handed to him/her, take it, as soon as possible, and in any event within 48 hours, if not sooner claimed by or on behalf of its owner, to the premises of the Private Hire operator, for whom he/she was working for at the time. The property will be given into safe custody of the Operator or his/her deputy, on him/her giving a receipt for its deposit.
N. The Licensee shall not permit or suffer any person to be carried in, on or about any private hire vehicle driven by him/her during a hiring without the express consent of the hirer of the vehicle.
O. The Licensee, if authorised by the proprietor of any private hire vehicle to act as the driver of such vehicle, shall not suffer any other person to act as driver of such vehicle without the consent of the proprietor thereof.
P. The Licensee shall not act as the driver of any private hire vehicle without the consent of the proprietor thereof.
Q. Private Hire vehicles must carry a guide dog or assistance dog belonging to the passenger, free of charge, unless the Licensee has a proven medical condition that would preclude such action. Licensees have a responsibility to ensure that their company is aware of such a condition when they are first employed. Exemption to this condition will only be given on production of a medical certificate.
R. The Licensee must inform the Licensing Officer of Three Rivers District Council, in writing, of any change of his/her address and/or operator, within 7 days
S. The Licensee must inform the Licensing Officer of Three Rivers District Council, if, whilst responsible for a licensed Private Hire vehicle, it is involved in a Road Traffic Accident, of any kind, with 72 hours.
T. The driver of a Private Hire Vehicle, licensed by Three Rivers District Council, must NOT in any circumstances use the horn of the vehicle to attract a customer or to let a customer known that they have arrived at a pre-arranged meeting place
