Policy for 2nd February 2010 Empty Policy for 2nd February 2010

Post by Licensing Section Mon 25 Jan 2010 - 10:04

There is only one policy item for discussion at the meeting to be held on 2nd Ferbruary 2010. The Policy to be reviewed is the policy on the use of Section 52, of the Road Safety Act 2006, by Officers and the Council's Licensing Board, the Law gives the Council the right to suspend a drivers licence with immediate effect and was introduced in 2007, The current policy is in simple terms. :-

1, Senior Licensing Officers have delegated powers to suspend a drivers licence with immediate effect if there is eveidence that public safety maybe compromised. They do not have powers to revoke a licence.

2, Where officers make this decision the licensee must be referred to the next avialbale licensing board as an emergency item. The Licensing Board then have the power to revoke or reinstate or leave the licence suspended.

This is a review under the timescales of the policy reveiw (every three years) and there are no recomendations from officers to change the policy.

I will of course update this after the meeting of 2nd February 2010. Of course the full report will be avialabe on the Council website shortly.
